3 Conclusion of the contract

It contains the reference to the General Conditions of Sale, the images of each product and its price, the means of payment that can be used, the delivery methods of the products purchased and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal; methods and times for returning the purchased products.

The contract is concluded when the seller receives the goods, after checking the correctness of the data contained therein.

5 Product availability

Product availability refers to actual availability at the time the buyer places the order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other customers before confirming the order.

Even after sending the order confirmation e-mail, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the unavailable product and the buyer will be immediately informed by e-mail.

If the buyer requests the cancellation of the order, resolving the contract, MICHELE FIORENTINO will refund the amount paid within 30 days from the moment in which MICHELE FIORENTINO became aware of the buyer's decision to terminate the contract.

7 Methods of payment and prices

The price of the products will be the one indicated from time to time on the site, except where there is an obvious error.

In the event of an error MICHELE FIORENTINO will notify the buyer as soon as possible, allowing confirmation of the order at the correct amount or cancellation. In any case, there will be no obligation for MICHELE FIORENTINO to supply what was sold at the lower price erroneously indicated.

The site prices include VAT, do not include shipping costs. Prices are subject to change at any time. The changes do not affect orders for which order confirmation has already been sent.

Once the products have been selected they will be added to the cart. It will be sufficient to follow the instructions for the purchase, entering or verifying the information requested in each step of the process. The order details can be modified before payment.

Payment can be made by: Credit card. The credit cards accepted will be the following: VISA, MASTERCARD, AMERICAN EXPRESS.

In addition, payment can be made via PayPal.

8 Delivery

For the ecommerce service MICHELE FIORENTINO, deliver directly or using specialized couriers. The purchased products are delivered directly to the address indicated during the purchase procedure. Each shipment contains the goods ordered and the related accompanying documentation. Delivery times may vary depending on the availability of the goods, but in normal conditions they are around 2/15 working days. Shipping costs amount to 7 euros (VAT included), (Venice Lagoon and islands excluding the cost of which is 12 euros). Upon delivery, the customer is required to verify that the package is intact, not damaged. Only after this verification will he have to accept the delivery, otherwise he will be required to reject the package. If the goods arrive at their destination broken or damaged MICHELE FIORENTINO undertakes to replace the product at its own expense, only and exclusively if the recipient has found the breakage or damage in the presence of the courier who made the delivery or if he indicated on the reception document. If there is no correspondence between the order and delivery, the customer must not accept the goods and must raise the dispute directly to the courier and call or send an email to customer service at info@michelefiorentino.it

MICHELE FIORENTINO also makes shipments abroad. Conditions, times and methods will be defined directly with the customer prior or upon order placement.

9 Passing of risk

The risks relating to the products will pass to the buyer from the moment of delivery. The ownership of the products is considered acquired as soon as full payment of all amounts due in relation to them has been received, including shipping costs, or at the time of delivery, should this occur later.

10 Warranty and commercial compliance

The seller is responsible for any defect in the products offered on the site, including the non-conformity of the items with the products ordered, in accordance with the provisions of Italian law.

If the buyer has entered into the contract as a consumer or any natural person who acts on the site for purposes unrelated to any business or professional activity carried out, this warranty is valid provided that the defect occurs within 7 days from the date of delivery of products; that the company is correctly informed by e-mail info@michelefiorentino.it .

In case of non-compliance, the buyer who entered into the contract as a consumer will be entitled to obtain the restoration of conformity of the products without charge, by repair or replacement.

All return costs for defective products will be borne by the seller.

11 Withdrawal

In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 days pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products . The buyer who intends to exercise the right of withdrawal must communicate it to MICHELE FIORENTINO through an explicit declaration, which can be sent by registered letter with acknowledgment of receipt to MICHELE FIORENTINO, Strada Comunale Simeone 3 - 71017 Torremaggiore (FG), Italy.

The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will reimburse the amount of the products subject to withdrawal within a maximum period of 30 days, excluding the shipping costs of delivery and collection which will remain the responsibility of the buyer .

As required by art. 56 paragraph 3 of Legislative Decree 206/2005, modified by Legislative Decree 21/2014, the site may suspend the refund until receipt of the goods or until the buyer has demonstrated that he has sent the goods back.

The site will carry out the refund using bank transfer as the payment method.

12 Data processing

The purchaser's data are processed in accordance with the provisions of the personal data protection legislation, as specified in the specific section containing the information pursuant to art. 13 Legislative Decree June 30, 2003 (Privacy Policy).

13 Safeguard clause

In the event that one of the clauses of these General Conditions of Sale is void for any reason, this will in no case compromise the validity and compliance with the other provisions contained in these General Conditions of Sale.

15 Applicable law and jurisdiction

These General Conditions of Sale are governed by Italian law and interpreted on the basis of it, without prejudice to any other prevailing mandatory rule in the country of habitual residence of the purchaser. Consequently, the interpretation, execution and resolution of the General Conditions of Sale are subject exclusively to Italian law and any inherent and / or consequent disputes thereof must be resolved exclusively by the Italian judicial authority. In particular, if the buyer holds the status of Consumer, any disputes must be resolved at the Court of North Naples.
